Terms of Service

These Terms of Service ("Terms") govern your access to and use of Hypedrive (the "Platform"), operated from India. By creating an account, enrolling a purchase, funding a campaign, or otherwise using the Platform, you agree to these Terms.

1. What Hypedrive is

Hypedrive is a rewards marketplace that connects creators and brands. Creators buy a brand's product with their own money, enroll the purchase, post the agreed content, and — once the brand approves — receive their money back as cashback (a rebate on the verified purchase) plus a bonus.

2. Eligibility

• You must be at least 18 years old and able to form a binding contract.
• You must provide accurate account information and keep it up to date.
• You are responsible for activity under your account. Tell us immediately at support@hypedrive.app if you suspect unauthorised use.

3. Creators: buying, enrolling and getting paid

• You buy the product with your own money on the brand's store. The purchase, delivery and any product issues are between you and that store.
• You enroll the purchase by uploading a genuine order screenshot. We verify it automatically against the brand's listing and screen it for fraud.
• You create and post the content the campaign specifies, from your own accounts, following the stated brief and platform rules.
• Once the brand approves your content, your cashback and bonus are credited to your Hypedrive wallet, from which you can withdraw to bank or UPI.
• Fabricated receipts, fake reach, bots, undisclosed paid content, or content that breaks a platform's rules will be rejected and may result in forfeiture and account action.

4. Brands: funding and approving campaigns

• You fund a campaign upfront and set the cashback, bonus and content requirements. Funds are held against approved results.
• You review submitted content and approve or reject it against your stated brief. You may not reject content that genuinely meets the published requirements purely to avoid paying.
• On approval, the creator's cashback and bonus are released and the platform fee plus applicable GST apply. Billing is consolidated on one weekly invoice.
• You are responsible for the accuracy of your listing, pricing and product claims.

5. Fees and taxes

Creators pay nothing to use Hypedrive. Brands pay a platform fee on campaign funding plus applicable Goods and Services Tax (GST), itemised on the weekly invoice.

6. Payouts

Payouts are made to the wallet, bank account or UPI ID you provide. You are responsible for the accuracy of those details and for any taxes you owe on amounts you earn.

7. Acceptable use

You agree not to submit false purchases, manipulated screenshots, or inauthentic engagement; misrepresent a paid partnership; infringe anyone's rights; or interfere with the Platform.

8. Intellectual property

You keep ownership of content you create. By submitting content to a campaign you grant the brand the licence stated in that campaign's brief, and you grant Hypedrive a limited licence to host, display and process it to operate the Platform.

9. Suspension and termination

We may suspend or close an account that breaches these Terms, poses a fraud or security risk, or is required by law.

10. Disclaimers and liability

The Platform is provided "as is". To the extent permitted by law, Hypedrive is not liable for indirect or consequential losses, and our total liability for any claim is limited to the fees you paid to Hypedrive in the three months before the claim.

11. Changes and governing law

We may update these Terms; material changes will be notified in-app or by email. These Terms are governed by the laws of India.
